Terms of Use

1. ACCEPTANCE OF TERMS

These Terms of Use ("Terms") constitute a legally binding agreement between you and Level Journey ("we," "us," or "our") regarding your use of the Level Journey mobile application and any related services, features, content, or applications (collectively, the "Service").

By accessing or using the Service, you acknowledge that you have read, understood, and agree to be bound by these Terms. If you are entering into these Terms on behalf of a company or other legal entity, you represent that you have the authority to bind such entity to these Terms.

2. ELIGIBILITY

You must be at least 13 years of age to use the Service. By using the Service, you represent and warrant that:

• You are at least 13 years old;
• You have the right, authority, and capacity to agree to these Terms;
• You will use the Service in accordance with these Terms;
• You are not prohibited from receiving the Service under the laws of your jurisdiction.

If you are under 18 years of age, you represent that you have your parent or guardian's permission to use the Service and that they have read and agreed to these Terms on your behalf.

3. ACCOUNT REGISTRATION

To access certain features of the Service, you need to register for an account. When registering, you agree to:

• Provide accurate, current, and complete information;
• Maintain and promptly update your account information;
• Keep your password secure and confidential;
• Notify us immediately of any unauthorized access to your account;
• Accept responsibility for all activities that occur under your account.

We reserve the right to refuse registration, cancel accounts, or remove or edit content at our sole discretion.

3.1 Authentication Methods

Level Journey offers the following authentication methods:

• Email and Password: You may register and sign in using your email address and a password you create.
• Sign in with Apple: You may use your Apple ID to authenticate with our Service. When using Sign in with Apple, you agree to comply with Apple's terms of service.

If you choose to use Sign in with Apple, you understand that:

• Apple's terms and privacy policy also apply to your use of their authentication service;
• You may manage your Sign in with Apple settings through your Apple ID account settings;
• Disabling Sign in with Apple for our app may impact your ability to access your account;
• We receive only the information you explicitly choose to share, which may include a unique identifier and optionally your email address;
• Account deletion requests will be honored regardless of your authentication method.

4. USER CONTENT

The Service allows you to create, store, and share content, including but not limited to custom fields, tasks, and progress data ("User Content").

4.1 Ownership

You retain all ownership rights in your User Content. By submitting User Content to the Service, you grant us a limited license to use, store, and process your User Content solely for the purpose of providing and improving the Service. This includes:

• Storing your data on our secure servers;
• Displaying your progress and achievements within the app;
• Processing your data to provide personalized features;
• Analyzing anonymized usage patterns to improve the service.

We do not claim ownership rights in your User Content and will not use it for purposes beyond providing the Level Journey service.

4.2 Restrictions

You may not upload, transmit, or share User Content that:

• Infringes any third-party intellectual property rights;
• Contains offensive, harmful, threatening, abusive, or otherwise objectionable material;
• Contains illegal content or promotes illegal activities;
• Impersonates another person or entity;
• Contains personal or confidential information of another person without their consent;
• Contains viruses, malware, or other harmful code;
• Spams or solicits other users.

4.3 Monitoring and Removal

We have the right, but not the obligation, to monitor User Content for compliance with these Terms. We may remove or refuse to display User Content that we believe violates these Terms or may harm our Service or users.

5. INTELLECTUAL PROPERTY RIGHTS

The Service, including all content, features, and functionality, is owned by Level Journey or its licensors and is protected by copyright, trademark, and other intellectual property laws.

5.1 Limited License

Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to download and use the App on a personal device that you own or control for your personal, non-commercial use.

5.2 Restrictions

You may not:

• Modify, adapt, translate, reverse engineer, decompile, or disassemble the App;
• Create derivative works based on the App or any part thereof;
• Remove, alter, or obscure any copyright, trademark, or other proprietary notices;
• Use the App for any commercial purpose;
• Use automated means to access or collect data from the App;
• Interfere with or disrupt the App or servers or networks connected to the App;
• Distribute, rent, lease, or sublicense the App to any third party.

6. PRIVACY

Your privacy is important to us. Our Privacy Policy, which is incorporated into these Terms by reference, explains how we collect, use, and disclose information about you when you use the Service. By using the Service, you consent to our collection, use, and disclosure of information as described in our Privacy Policy.

7. THIRD-PARTY SERVICES

The Service may contain links to or integrate with third-party websites or services. We are not responsible for the content, privacy policies, or practices of any third-party websites or services. We encourage you to read the terms and conditions and privacy policy of each third-party service that you visit or use.

8. SUBSCRIPTIONS AND IN-APP PURCHASES

8.1 Subscription Tiers

Level Journey offers three premium subscription options:

• Monthly Subscription: $4.99 per month, billed monthly
• Annual Subscription: $29.99 per year, billed annually
• Lifetime Purchase: $79.99 one-time payment for permanent premium access

Prices may vary by region and are displayed in your local currency at the time of purchase.

8.2 Auto-Renewal Terms

Monthly and Annual subscriptions automatically renew unless you cancel at least 24 hours before the end of the current billing period. You will be charged through your Apple ID account at confirmation of purchase.

Your subscription will automatically renew at the same price unless:

• You cancel the subscription at least 24 hours before renewal
• We notify you of a price change and you choose not to accept
• Your payment method fails and you do not update it within the grace period

8.3 No Free Trial

Level Journey does not currently offer a free trial period. You will be charged immediately upon subscribing to a monthly or annual plan. However, you can cancel your subscription at any time, and you will retain premium access until the end of your current billing period.

8.4 Managing Your Subscription

You can manage and cancel your subscription at any time through your Apple ID account settings:

1. Open the Settings app on your device
2. Tap your name at the top
3. Tap "Subscriptions"
4. Select "Level Journey"
5. Choose "Cancel Subscription"

You can also manage subscriptions directly from the App Store app or at apps.apple.com/account/subscriptions.

8.5 Cancellation Policy

When you cancel your subscription:

• You retain premium access until the end of your current billing period
• No refund is provided for the unused portion of your subscription
• Your subscription will not renew at the end of the period
• After expiration, you will revert to the free tier with limited features

Lifetime purchases cannot be cancelled as they are one-time, non-recurring transactions.

8.6 Refund Policy

All purchases are processed through Apple's App Store. Refund requests must be submitted directly to Apple, not to Level Journey.

To request a refund from Apple:

1. Go to reportaproblem.apple.com
2. Sign in with your Apple ID
3. Find your Level Journey purchase
4. Select "Request a Refund"
5. Choose a reason and submit

Apple reviews all refund requests on a case-by-case basis according to their refund policy. We do not control Apple's refund decisions.

If Apple approves your refund:

• Your premium access will be immediately revoked
• Your account will revert to the free tier
• Any premium-exclusive data (e.g., extra fields beyond the free limit) may be restricted

8.7 Billing Issues and Grace Period

If your payment method fails during subscription renewal, Apple will attempt to collect payment for up to 16 days (the "grace period"). During this time:

• You retain full premium access
• Apple will retry charging your payment method
• You will receive notifications to update your payment information

If payment is not successful within 16 days, your subscription will be cancelled and premium access will be revoked.

8.8 Premium Features

Premium subscriptions unlock the following features:

• Increased field limit (12 fields vs. 3 for free users)
• Access to all 9 character classes (vs. 3 for free users)
• Enhanced item drop rates (65% vs. 50% for free users)
• 2x streak freeze multiplier
• Advanced Soul Mirror features (mood analytics, AI insights)
• Priority support access
• Early access to new features

We reserve the right to add, remove, or modify premium features at any time. Significant changes will be communicated via in-app notification or email.

8.9 Subscription Changes

We reserve the right to:

• Change subscription pricing with 30 days advance notice to existing subscribers
• Modify the features included in premium subscriptions
• Discontinue certain subscription tiers
• Offer promotional pricing or limited-time discounts

If we increase the price of your subscription, you will be notified at least 30 days in advance. Your subscription will renew at the current price until you accept the new price.

8.10 Restore Purchases

You can restore your previous purchases at any time by:

1. Opening Level Journey
2. Navigating to Settings > Subscription
3. Tapping "Restore Purchases"

This will sync your current subscription status with Apple's servers and restore premium access if you have an active subscription.

9. DISCLAIMER OF WARRANTIES

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING, BUT NOT LIMITED TO, IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.

WE DO NOT WARRANT THAT:

• THE SERVICE WILL FUNCTION UNINTERRUPTED, SECURE, OR AVAILABLE AT ANY PARTICULAR TIME OR LOCATION;
• ANY ERRORS OR DEFECTS WILL BE CORRECTED;
• THE SERVICE IS FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS;
• THE RESULTS OF USING THE SERVICE WILL MEET YOUR REQUIREMENTS.

10. LIMITATION OF LIABILITY

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL LEVEL JOURNEY, ITS AFFILIATES, DIRECTORS, EMPLOYEES, OR LICENSORS BE LIABLE FOR ANY DIRECT, INDIRECT, PUNITIVE, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR EXEMPLARY DAMAGES, INCLUDING WITHOUT LIMITATION DAMAGES FOR LOSS OF PROFITS, GOODWILL, USE, DATA, OR OTHER INTANGIBLE LOSSES, THAT RESULT FROM THE USE OF, OR INABILITY TO USE, THIS SERVICE.

IN NO EVENT SHALL OUR TOTAL LIABILITY TO YOU FOR ALL DAMAGES, LOSSES, AND CAUSES OF ACTION EXCEED THE AMOUNT YOU HAVE PAID TO US IN THE LAST SIX (6) MONTHS, OR, IF GREATER, ONE HUNDRED DOLLARS ($100).

11. INDEMNIFICATION

You agree to defend, indemnify, and hold harmless Level Journey, its affiliates, licensors, and service providers, and its and their respective officers, directors, employees, contractors, agents, licensors, suppliers, successors, and assigns from and against any claims, liabilities, damages, judgments, awards, losses, costs, expenses, or fees (including reasonable attorneys' fees) arising out of or relating to your violation of these Terms or your use of the Service.

12. TERMINATION

We may terminate or suspend your account and access to the Service immediately, without prior notice or liability, at our sole discretion, for any reason whatsoever, including without limitation if you breach these Terms.

Upon termination:

• Your right to use the Service will immediately cease;
• Your account and associated data will be marked for deletion from our systems;
• Your personal information (email address) will be deleted or anonymized within 30 days;
• Some anonymous usage data may be retained for improving the service.

If you wish to terminate your account, you may do so by:

1. Navigating to Settings > Danger Zone within the app
2. Selecting "Delete Account"
3. Confirming your decision when prompted

13. CHANGES TO TERMS

We reserve the right, at our sole discretion, to modify or replace these Terms at any time. We will provide notice of any changes by posting the new Terms on this page and updating the "effective date" at the top of these Terms.

Your continued use of the Service after any such changes constitutes your acceptance of the new Terms. If you do not agree to the new Terms, you must stop using the Service.

14. GOVERNING LAW

These Terms shall be governed by the laws of the Czech Republic, where the developer is based.

If you are a consumer in a country with stronger consumer protection laws, those additional protections may still apply to you.

15. DISPUTE RESOLUTION

If you have any concerns or disputes about the Service, please contact us directly at support@level-journey.com. We'll do our best to resolve any issues informally.

16. SEVERABILITY

If any provision of these Terms is held to be unenforceable or invalid, such provision will be changed and interpreted to accomplish the objectives of such provision to the greatest extent possible under applicable law and the remaining provisions will continue in full force and effect.

17. WAIVER

The failure of Level Journey to enforce any right or provision of these Terms will not be considered a waiver of those rights. The waiver of any such right or provision will be effective only if in writing and signed by a duly authorized representative of Level Journey.

18. ENTIRE AGREEMENT

These Terms constitute the entire agreement between you and Level Journey regarding the Service and supersede all prior and contemporaneous written or oral agreements between you and Level Journey.

19. APPLE APP STORE ADDITIONAL TERMS

If you download the App from the Apple App Store, the following additional terms apply:

• These Terms are between you and Level Journey only, not with Apple Inc. ("Apple"). Apple is not responsible for the App and its content.
• Your license to use the App is limited to a non-transferable license to use the App on any Apple-branded products that you own or control, as permitted by the Usage Rules set forth in the App Store Terms of Service.
• Apple has no obligation to furnish any maintenance and support services with respect to the App.
• Apple is not responsible for addressing any claims by you or any third party relating to the App or your possession and/or use of the App, including: (a) product liability claims; (b) any claim that the App fails to conform to any applicable legal or regulatory requirement; and (c) claims arising under consumer protection or similar legislation.
• In the event of any third-party claim that the App or your possession and use of the App infringes that third party's intellectual property rights, Apple will not be responsible for the investigation, defense, settlement, and discharge of any such intellectual property infringement claim.
• You represent and warrant that (a) you are not located in a country that is subject to a U.S. Government embargo, or that has been designated by the U.S. Government as a "terrorist supporting" country; and (b) you are not listed on any U.S. Government list of prohibited or restricted parties.
• Apple and its subsidiaries are third-party beneficiaries of these Terms, and upon your acceptance of the Terms, Apple will have the right (and will be deemed to have accepted the right) to enforce these Terms against you as a third-party beneficiary.
